Dear Mr. Yılmaz Işık
Re: HMS PROPERTY SERVICES
I have been advised to contact you because of your growing reputation for being able to resolve contentious business matters quickly and without fuss. I am sure that you must be very busy, but I would be very grateful if you can find the time to assist me with a problem I have encountered with the above named business.
By way of background I should advise you that I live in a modest but very pretty 2 bedroom bungalow of traditional Cyprus style and, have done so since the year 2001. The one great sadness for me is that my husband died in 2007 and thus I am alone, but thankfully with many friends both Cypriot and British.
I am unsure of the legal status of HMS Property Services. I doubt it is under the umbrella of a corporate entity as no registration details are shown on the documentation in use. It could be a partnership involving at least 2 partners who are known to me as Steve Smythe and Paul Moore or equally Steve Smythe, as a sole trader who employs or sub contracts to others. These 2 names are shown on their business card. I have only ever contracted with the person known as Steve Smythe in his capacity as HMS Property Services. Subsequently, I have realised that I have no idea whether or not this business is duly registered with the appropriate authorities to conduct trade.
I enclose with this letter copies of correspondence with HMS Property Services and you will find this self explanatory. However, in amplification and confirmation of this, I include here the sequence of events which has ended in so much worry for me.
1. I contracted with Steve Smythe in May 2009 for my flat concrete roof to be waterproofed and he assured me that this was a task that his business could professionally and satisfactorily undertake. We agreed a sum of £1,700 subsequently amended to £1,300.
2. I paid Steve Smythe £1300 in May 2009 when he advised me that the work was completed satisfactorily. I did not inspect the work at this time as there are no stairs to the roof and at 61 years of age I am fearful of ladders. I simply trusted him.
3. Believing that the roof was watertight and no dampness would seep through internal ceilings I contracted with a local Cypriot builder and spent several thousand pounds on a new windows, doors, and redecoration of all ceilings and walls. In August 2009 the builder went up a ladder to see the source of the water pipes as I had asked him to fit an external water tap. He told me that he could not believe that it was a new roof liner as it was in an appalling condition. I permitted him to go onto the roof where he found no less that 50 pieces of liner fitted like patchwork with no more than 2 or 3 centimetres of overlap and even no everlap at all, precious little signs of adhesive, with gaps in the seams and pieces which could be lifted like rugs. I am professionally advised that overlaps should have been 10 to 15 centimetres minimum and the rolls of roofing a minimum of 10 metres long. All in all the work was a complete failure and must be done again using good quality liner, properly fitted.
4. I have photographs of the condition of the roof within 3 months of paying Steve Smythe £1.300.
5. My current builder is a Mr. Cemal Altan and his telephone number is 0542 859 0838. He confirms that he is willing to bear witness to all that I have said regarding this situation and if it would help you to discuss this matter with him in the Turkish language Mr. Altan will be pleased to try and assist you.
From the enclosed correspondence you will see that HMS Property Services refuse to refund me any money to defray the cost of having the task done again by competent people. Further, by refusing to allow them to add further patches to a roof liner which is beyond repair and was from the start they say I have forfeited my rights. They have verbally blamed a Cypriot subcontractor for the problems though I never saw a Cypriot worker making any visit to the site other than for a few minutes. They also commented that they treat a widow the same as any other customer. I have never wanted anything more than that. Whilst I made no comment in reply, and applying "the balance of probabilities" to my thoughts I must believe that they told me nobody must go on the roof not because of the risk of damage but they did not wish the shoddy workmanship to be seen and hence the £400 underspend to allay any suspicions. Certainly, if my husband were alive he would have inspected the work and they would not of been paid until the job was done satisfactorily.
Overall, I am not looking for revenge by going to law and would much rather have this matter brought to an amicable conclusion if possible. You will understand that as a pensioner with limited income and savings I cannot afford to allow the internal décor to be ruined having saved for over 5 years to pay for it. As the Winter draws near I am also anxious to get matters resolved quickly. Any assistance or advice you can offer would be very gratefully received. I hope to hear from you in due course.
Yours Sincerely,
Gwen Cassel
